3. Rechtsgrundlagen
Wir verarbeiten Ihre Daten auf diesen Grundlagen der Datenschutz-Grundverordnung (DSGVO):

• Einwilligung (Art. 6 Abs. 1 lit. a; für Gesundheitsdaten Art. 9 Abs. 2 lit. a), z. B. Newsletter, Cookies, Gesundheitsangaben
• Vertrag und vorvertragliche Maßnahmen (Art. 6 Abs. 1 lit. b), z. B. Beratung, Vermittlung, Mitgliedschaft
• Rechtliche Pflichten (Art. 6 Abs. 1 lit. c), z. B. Beratungsdokumentation, Aufbewahrungspflichten
• Berechtigtes Interesse (Art. 6 Abs. 1 lit. f), z. B. sicherer Betrieb der Website, Beantwortung von Anfragen

Für das Speichern und Auslesen von Informationen auf Ihrem Endgerät gilt zusätzlich § 25 TDDDG: Technisch notwendige Cookies setzen wir ohne, alle anderen nur mit Ihrer Einwilligung.

4. Empfänger und Dienstleister
Wir geben Ihre Daten nur weiter, wenn es für den jeweiligen Zweck nötig ist. Dienstleister, die in unserem Auftrag arbeiten, sind durch einen Vertrag zur Auftragsverarbeitung (Art. 28 DSGVO) gebunden.

Eigenständige Empfänger im Rahmen der Vermittlung sind Versicherungsgesellschaften, Produktanbieter von Finanzanlagen, unser Maklerpool Fonds Finanz Maklerservice GmbH (München) sowie Vergleichs- und Angebotsplattformen (Professional Works, BT4All).

5. Übermittlung in Drittländer
Einige Dienstleister sitzen in den USA. Eine Übermittlung erfolgt nur, wenn ein angemessenes Datenschutzniveau gesichert ist: durch die Zertifizierung des Empfängers nach dem EU-US Data Privacy Framework (Angemessenheitsbeschluss der EU-Kommission vom 10.07.2023) oder durch EU-Standardvertragsklauseln (Art. 46 DSGVO). HighLevel LLC ist nach dem Data Privacy Framework zertifiziert.

6. Speicherdauer
Wir löschen Ihre Daten, sobald der Zweck entfällt und keine Aufbewahrungspflicht entgegensteht. Handels- und steuerrechtliche Unterlagen bewahren wir 6 bis 10 Jahre auf, Beratungs- und Vermittlungsunterlagen bis zum Ablauf möglicher Haftungsansprüche, in der Regel bis zu 10 Jahre nach Vertragsende. Konkrete Fristen nennen wir bei den einzelnen Verarbeitungen.

7. Ihre Rechte
Sie haben das Recht auf Auskunft (Art. 15), Berichtigung (Art. 16), Löschung (Art. 17), Einschränkung der Verarbeitung (Art. 18) und Datenübertragbarkeit (Art. 20). Eine Einwilligung können Sie jederzeit mit Wirkung für die Zukunft widerrufen (Art. 7 Abs. 3), z. B. per E-Mail an [email protected].

8. Widerspruchsrecht (Art. 21 DSGVO)
Verarbeiten wir Ihre Daten auf Grundlage eines berechtigten Interesses, können Sie aus Gründen, die sich aus Ihrer besonderen Situation ergeben, jederzeit widersprechen. Der Verarbeitung für Direktwerbung können Sie jederzeit ohne Angabe von Gründen widersprechen.

9. Beschwerderecht

10. Pflicht zur Bereitstellung, keine automatisierten Entscheidungen
Ohne die für Beratung und Vermittlung nötigen Angaben können wir Sie nicht beraten und keine Verträge vermitteln. Eine ausschließlich automatisierte Entscheidung einschließlich Profiling (Art. 22) findet nicht statt.

Teil B – Unsere Website

11. Hosting und Server-Logfiles
Unsere Website wird bei HighLevel LLC (GoHighLevel) betrieben. Beim Aufruf werden automatisch IP-Adresse, Datum und Uhrzeit, aufgerufene Seite, Referrer-URL, Browser und Betriebssystem verarbeitet, um die Website auszuliefern und vor Angriffen zu schützen (Art. 6 Abs. 1 lit. f). Speicherdauer: bis zu 14 Tage.

12. Verschlüsselung
Unsere Website nutzt eine TLS-Verschlüsselung. Sie erkennen sie an „https://“ und dem Schloss-Symbol im Browser.

13. Cookies und Einwilligungsverwaltung
Technisch notwendige Cookies (z. B. Sitzung, Speicherung Ihrer Cookie-Auswahl) setzen wir auf Grundlage von § 25 Abs. 2 TDDDG und Art. 6 Abs. 1 lit. f. Alle anderen Cookies und Tracking-Techniken setzen wir nur, wenn Sie im Cookie-Banner zustimmen (§ 25 Abs. 1 TDDDG, Art. 6 Abs. 1 lit. a). Ihre Auswahl können Sie jederzeit über Cookie-Einstellungen ändern.

14. Analyse und Werbung
Mit Ihrer Einwilligung nutzen wir das Meta-Pixel der Meta Platforms Ireland Ltd., Merrion Road, Dublin 4, Irland. Damit messen wir, wie gut unsere Werbeanzeigen auf Facebook und Instagram wirken, und können Besuchern unserer Website Anzeigen zeigen (Remarketing). Dabei werden IP-Adresse, Browserdaten, aufgerufene Seiten und Aktionen (z. B. das Absenden eines Formulars) an Meta übermittelt; Meta kann diese Daten mit Ihrem Facebook- oder Instagram-Konto verknüpfen. Für Erhebung und Übermittlung sind wir mit Meta gemeinsam verantwortlich (Art. 26 DSGVO), die weitere Verarbeitung verantwortet Meta allein. Daten können an Meta Platforms Inc. in den USA übermittelt werden; Meta ist nach dem EU-US Data Privacy Framework zertifiziert. Rechtsgrundlage ist Ihre Einwilligung (§ 25 Abs. 1 TDDDG, Art. 6 Abs. 1 lit. a DSGVO), die Sie jederzeit über „Cookie-Einstellungen“ widerrufen können. 15. Kontaktformular und Terminbuchung
Wenn Sie unser Formular ausfüllen oder einen Termin buchen, verarbeiten wir Ihre Angaben (z. B. Name, E-Mail, Telefonnummer, Anliegen, Wunschtermin) in unserem CRM (GoHighLevel), um Ihre Anfrage zu bearbeiten und den Termin vorzubereiten (Art. 6 Abs. 1 lit. b und f). Kommt kein Vertrag zustande, löschen wir die Daten nach 24 Monaten ohne weiteren Kontakt.

16. Newsletter
Für den Newsletter brauchen wir Ihre E-Mail-Adresse und Ihre Einwilligung (Art. 6 Abs. 1 lit. a). Wir nutzen das Double-Opt-in-Verfahren und protokollieren Anmeldung und Bestätigung. Versand über GoHighLevel. Abmelden können Sie sich jederzeit über den Link in jeder E-Mail. Danach löschen wir Ihre Adresse aus dem Verteiler.

17. Social Media
Wir sind auf Instagram, Facebook, TikTok und YouTube vertreten. Wenn Sie unsere Profile besuchen, verarbeiten die Plattformbetreiber Ihre Daten nach eigenen Bedingungen. Für Statistiken unserer Facebook- und Instagram-Seiten sind wir mit Meta Platforms Ireland Ltd. gemeinsam verantwortlich (Art. 26 DSGVO). Links auf unserer Website zu diesen Plattformen sind einfache Links; Daten werden erst beim Anklicken übertragen.

Teil C – Kunden und Interessenten

18. Beratung und Vermittlung
Für Beratung und Vermittlung von Versicherungen und Finanzanlagen verarbeiten wir Stammdaten (Name, Anschrift, Geburtsdatum, Kontaktdaten), Angaben zu Beruf, Einkommen, Vermögen, Zielen und bestehenden Verträgen. Wir nutzen dazu GoHighLevel und Capital Flow. Zur Vermittlung geben wir die nötigen Daten an Versicherer, Produktanbieter und unseren Maklerpool weiter (Art. 6 Abs. 1 lit. b und c).

19. Gesundheitsdaten
Für manche Versicherungen (z. B. Berufsunfähigkeits- oder private Krankenversicherung) brauchen wir Angaben zu Ihrer Gesundheit. Diese verarbeiten und übermitteln wir nur mit Ihrer ausdrücklichen, schriftlichen Einwilligung (Art. 9 Abs. 2 lit. a), die Sie jederzeit widerrufen können.

20. Kommunikation
Wir kommunizieren per E-Mail (Google Workspace), Telefon, WhatsApp (über GoHighLevel bzw. Meta Platforms Ireland Ltd.) und Videocall (Zoom, Google Meet). Bitte senden Sie uns sensible Unterlagen wie Gesundheitsangaben nicht unverschlüsselt per E-Mail oder WhatsApp, sondern über sicherer Upload, z. B. Google Workspace und Capital Flow.

21. Mitgliedschaft und Zahlung
Für Mitgliedschaften verarbeiten wir Vertrags- und Zahlungsdaten. Zahlungen wickelt Stripe ab; Stripe erhält dafür Name, E-Mail und Zahlungsdaten. Rechnungsdaten gehen an unsere Buchhaltung und unseren Steuerberater (Art. 6 Abs. 1 lit. b und c).

22. Community und Academy
Im Mitgliederbereich (GoHighLevel) und in der Community (Skool) verarbeiten wir Ihr Profil, Ihre Beiträge und Ihren Lernfortschritt, um Ihnen die Inhalte bereitzustellen (Art. 6 Abs. 1 lit. b).

23. Bewertungen
Nach einer Beratung bitten wir Sie eventuell um eine Bewertung auf ProvenExpert. Wir übermitteln dafür nur Name und E-Mail-Adresse, wenn Sie zugestimmt haben (Art. 6 Abs. 1 lit. a).

24. Änderungen
Wir passen diese Datenschutzerklärung an, wenn sich unsere Verarbeitung oder die Rechtslage ändert. Es gilt die jeweils auf der Website veröffentlichte Fassung.

4. Destinatarios y proveedores

UU.) para web, CRM, citas, mensajes, boletín y área de miembros; Capital Flow (CapitalFlow GmbH, Stuttgart) para análisis financiero y propuestas; Google Workspace (Google Ireland Ltd.); Zoom (EE. UU.); Stripe (Stripe Payments Europe Ltd., Irlanda) para pagos; Qonto (Francia) como cuenta bancaria; nuestra contabilidad y asesor fiscal; Skool para la comunidad; ProvenExpert para valoraciones; n8n para automatización. Para la intermediación, son destinatarios independientes las aseguradoras, los proveedores de productos de inversión, nuestro pool de corredores Fonds Finanz Maklerservice GmbH (Múnich) y plataformas de comparación y ofertas (Professional Works, BT4All).

5. Transferencias a terceros países
Algunos proveedores están en EE. UU. Solo transferimos datos si existe un nivel de protección adecuado: certificación del destinatario en el EU-US Data Privacy Framework (decisión de adecuación de la Comisión Europea del 10.07.2023) o cláusulas contractuales tipo de la UE (art. 46 RGPD). HighLevel LLC está certificada en el Data Privacy Framework.

6. Plazo de conservación
Borramos tus datos cuando ya no son necesarios y no existe obligación legal de conservarlos. Los documentos mercantiles y fiscales se conservan de 6 a 10 años; los de asesoramiento e intermediación, hasta que prescriban posibles reclamaciones, normalmente hasta 10 años tras el fin del contrato.

7. Tus derechos
Tienes derecho de acceso (art. 15), rectificación (art. 16), supresión (art. 17), limitación del tratamiento (art. 18) y portabilidad (art. 20). Puedes retirar tu consentimiento en cualquier momento con efecto para el futuro, por ejemplo escribiendo a [email protected].

8. Derecho de oposición (art. 21 RGPD)

19. Datos de salud: Para algunos seguros (p. ej. incapacidad laboral o seguro médico privado) necesitamos datos de salud. Solo los tratamos y transmitimos con tu consentimiento expreso por escrito (art. 9.2.a), que puedes retirar en cualquier momento.

20. Comunicación: Nos comunicamos por correo (Google Workspace), teléfono, WhatsApp y videollamada (Zoom, Google Meet). Por favor, no envíes documentos sensibles como datos de salud por correo o WhatsApp sin cifrar, sino por canal seguro.

21. Membresía y pagos: Tratamos datos del contrato y de pago. Los pagos los gestiona Stripe. Los datos de facturación van a nuestra contabilidad y asesor fiscal (art. 6.1.b y c).

22. Comunidad y academia: En el área de miembros (GoHighLevel) y la comunidad (Skool) tratamos tu perfil, tus publicaciones y tu progreso (art. 6.1.b).

4. Recipients and service providers
We share your data only where needed for the purpose. Providers acting on our behalf are bound by a data processing agreement (Art. 28 GDPR). We use: GoHighLevel (HighLevel LLC, USA) for website, CRM, bookings, messaging, newsletter and member area; Capital Flow (CapitalFlow GmbH, Stuttgart) for financial analysis and proposals; Google Workspace (Google Ireland Ltd.); Zoom (USA); Stripe (Stripe Payments Europe Ltd., Ireland) for payments; Qonto (France) for banking; our bookkeeping and tax adviser; Skool for the community; ProvenExpert for reviews; n8n for automation. Independent recipients in the course of brokerage are insurers, investment product providers, our broker pool Fonds Finanz Maklerservice GmbH (Munich) and comparison and quotation platforms (Professional Works, BT4All).

5. Transfers to third countries
Some providers are based in the USA. We transfer data only where an adequate level of protection is ensured: the recipient's certification under the EU-US Data Privacy Framework (European Commission adequacy decision of 10 July 2023) or EU standard contractual clauses (Art. 46 GDPR). HighLevel LLC is certified under the Data Privacy Framework.

6. Retention
We delete your data once it is no longer needed and no legal retention duty applies. Commercial and tax records are kept for 6 to 10 years; advice and brokerage records until potential liability claims expire, usually up to 10 years after the contract ends.

7. Your rights
You have the right of access (Art. 15), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18) and data portability (Art. 20). You can withdraw consent at any time with effect for the future, e.g. by e-mail to [email protected].

8. Right to object (Art. 21 GDPR)
Where we process your data based on legitimate interests, you may object at any time on grounds relating to your particular situation. You may object to processing for direct marketing at any time without giving reasons.

9. Right to lodge a complaint

10. Obligation to provide data; no automated decisions
Without the necessary data we cannot advise you or arrange contracts. We do not make decisions based solely on automated processing, including profiling (Art. 22).

Part B – Our website

11. Hosting and server logs: The website runs on GoHighLevel. When you visit it, your IP address, date and time, page visited, referrer URL, browser and operating system are processed to deliver the site and protect it from attacks (Art. 6(1)(f)).

12. Encryption: We use TLS encryption ("https://" and the padlock in your browser).

13. Cookies: Strictly necessary cookies are set under Section 25(2) TDDDG and Art. 6(1)(f). All others only if you accept them in the cookie banner (Section 25(1) TDDDG, Art. 6(1)(a)). You can change your choice under Cookie settings.

14. Analytics and advertising: With your consent we use the Meta Pixel of Meta Platforms Ireland Ltd., Merrion Road, Dublin 4, Ireland, to measure how well our ads on Facebook and Instagram perform and to show ads to visitors of our website (remarketing). Your IP address, browser data, pages visited and actions (e.g. submitting a form) are sent to Meta, which may link them to your Facebook or Instagram account. We are joint controllers with Meta for collection and transmission (Art. 26 GDPR); Meta alone is responsible for further processing. Data may be transferred to Meta Platforms Inc. in the USA, which is certified under the EU-US Data Privacy Framework. Legal basis: your consent (Section 25(1) TDDDG, Art. 6(1)(a) GDPR), which you can withdraw at any time under "Cookie settings". We use no other analytics or tracking tools.

15. Contact form and booking: We process the details you provide (name, e-mail, phone, request, preferred date) in our CRM (GoHighLevel) to answer you and prepare the appointment (Art. 6(1)(b) and (f)).

16. Newsletter: We need your e-mail address and consent (Art. 6(1)(a)). We use double opt-in. You can unsubscribe at any time via the link in every e-mail.

17. Social media: We are present on Instagram, Facebook, TikTok and YouTube. When you visit our profiles, each platform processes your data under its own terms. For page insights on Facebook and Instagram we are joint controllers with Meta Platforms Ireland Ltd. (Art. 26 GDPR). Links from our website to these platforms are plain links.

Part C – Clients and prospects

18. Advice and brokerage: We process identification and contact data, occupation, income, assets, goals and existing contracts, using GoHighLevel and Capital Flow. To arrange contracts we share the necessary data with insurers, product providers and our broker pool (Art. 6(1)(b) and (c)).

19. Health data: Some insurance (e.g. disability or private health insurance) requires health information. We process and transmit it only with your explicit written consent (Art. 9(2)(a)), which you may withdraw at any time.

20. Communication: We communicate by e-mail (Google Workspace), phone, WhatsApp and video call (Zoom, Google Meet). Please do not send sensitive documents such as health data by unencrypted e-mail or WhatsApp; use secure channel instead.

21. Membership and payments: We process contract and payment data. Payments are handled by Stripe. Billing data goes to our bookkeeping and tax adviser (Art. 6(1)(b) and (c)).

22. Community and academy: In the member area (GoHighLevel) and the community (Skool) we process your profile, posts and learning progress (Art. 6(1)(b)).

23. Reviews: With your consent we pass your name and e-mail to ProvenExpert to request a review (Art. 6(1)(a)).

24. Changes: We update this policy when our processing or the law changes. The version published on the website applies.
